Terms of Service

These Terms of Service ("Terms") govern your use of meritfi.co and the Merit service (the "Service"), operated by MeritFi Technologies, Inc. ("Merit", "we", "us"), a Delaware corporation.
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Merit is
Merit provides educational guidance and navigation for people making US credit decisions. You tell us what you are trying to do — for example obtaining a first US credit card, refinancing student debt, seeking a personal loan, or preparing for an apartment application — and we prepare a written Merit Report with educational guidance: what may be realistic for your situation, what may block you, what to consider avoiding, and what to consider doing first.
What Merit is not. Merit is not a lender, a loan broker, a credit repair organization, a credit reporting agency, or a financial institution. We do not issue credit, lend money, or extend financial products. We do not pull your credit or perform any credit inquiry, hard or soft. We do not ask for your Social Security Number or date of birth. We do not submit applications on your behalf — you apply directly with any provider you choose, and every provider makes its own decision under its own criteria, independent of Merit.
2. No credit decision, no guarantee
Nothing produced by the Service constitutes a credit decision, loan offer, pre-qualification, pre-approval, or guarantee of any outcome or terms. A Merit Report reflects our understanding of publicly available provider criteria and de-identified patterns observed across users at the time it is written. Provider criteria change without notice, and no report can guarantee how any provider will treat your application.
3. How Merit is compensated
The Service is free for you. Some providers referenced in Merit Reports pay Merit a referral fee if you open or fund a product after following a link we provide. Paid relationships are disclosed alongside the relevant recommendation. Compensation does not determine our guidance: reports reflect our honest assessment of fit for your situation, and reports may recommend providers that pay us nothing or advise you not to apply anywhere at all.
4. Eligibility
You must be at least 18 years old to use the Service. By using the Service you confirm that you are 18 or older and have the legal capacity to enter into these Terms.
5. Your account and information
You agree to provide accurate, current, and complete information; to update it if it changes materially; to use the Service only for personal, lawful purposes; and not to impersonate another person, create requests for others without authorization, or submit fraudulent information. Please redact sensitive identifiers (such as SSN or full account numbers) from any document you upload. Submitting false or misleading information may result in suspension or deletion of your account.
6. No financial advice
The Service provides general educational information and navigation, not financial, legal, tax, or investment advice. You should consult a qualified professional for advice specific to your situation. Decisions you make after receiving a Merit Report, including whether and where to apply for any product, are yours alone.
7. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to access another user's data; reverse engineer or attempt to extract the source code of the Service; use automated tools to scrape or harvest data from the Service; interfere with the operation or security of the Service; or submit content that is fraudulent, defamatory, or violates the rights of others. We may suspend or terminate your access for violations of these Terms.
8. Termination
You may stop using the Service and request deletion of your account at any time by emailing legal@meritfi.co. We may suspend or terminate your access at our discretion, with or without notice, if you violate these Terms or if we believe your use poses risk to other users, our systems, or our business.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any guidance will result in any particular outcome with any provider.
10. Limitation of liability
To the maximum extent permitted by law, Merit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service. Our total cumulative liability to you for all claims related to the Service is limited to one hundred US dollars ($100).
11. Intellectual property
The Service, including its design, code, content, and report methodology, is owned by MeritFi Technologies, Inc. You receive no rights to our intellectual property except the limited right to use the Service for its intended purpose. You retain ownership of the information you provide. By using the Service, you grant us a non-exclusive, royalty-free license to use that information to operate and improve the Service, including creating de-identified, aggregate patterns that help future users.
12. Changes to the Service and these Terms
We may modify, suspend, or discontinue all or part of the Service at any time, and may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware.
